Consumer Product Safety Improvement Act
United States toy manufacturers and importers are obliged to test children’s toy products to ensure free from hazardous substances, including lead and phthalates, and comply with toy safety requirements.
What is CPSIA?
CPSIA testing safeguards the compliance of children’s toy products with the US Consumer Product Safety Improvement Act (CPSIA). CPSIA includes the provision of addressing children’s products, which the Act defines as any product designed primarily for use by children aged 12 or younger.
In 2011, Public Law 112-28 amended the CPSIA providing Consumer Product Safety Commission (CPSC) with greater authority in enforcing consumer product safety laws including:
- Lead limits in paint and substrates contained in Section 101 of the CPSIA. The limit is further controlled under the Consumer Product Safety Act and Federal Hazardous Substances Act regulations.
- Phthalate limits in children’s toy or child care articles contained in Section 108 of the CPSIA.
